Reselling Policy & Resale Value Disclaimer

This Reselling Policy & Resale Value Disclaimer (the “Policy”) applies to jewelryresell.com and all related content, products, tools, communities, and services (collectively, the “Site”) operated by JewelryResell (“we,” “us,” “our”). By accessing the Site or purchasing from us, you agree to this Policy in addition to our Terms of Service, Refund / Return Policy, and Shipping Policy. If you do not agree, please do not use the Site.
1. No Guaranteed Resale Value
Any resale figure displayed anywhere on the Site or in our marketing — including but not limited to product-page “resell value” or “resell for” figures, cart “Total Resell Value” amounts, multiplier estimates (for example, “10x resale value”), banners, social media posts, videos, emails, and Discord content — is an estimate and marketing illustration only.
These figures are not:
- a guarantee, warranty, or promise of any resale price, profit, or outcome;
- an offer by us or by anyone else to purchase any item at any price;
- a professional appraisal, valuation, grading report, or certification; or
- a representation of what any specific buyer will pay for any specific item.
Actual resale prices depend on many factors outside our control, including item condition, buyer demand, the marketplace used, geography, timing, negotiation, fees, competition, and overall market conditions. You may resell an item for more than the estimate, for less, or not at all. YOU MAY LOSE MONEY.
2. Profit Calculator and Examples Are Illustrative
Tools and features such as our Profit Calculator, “Live Profit HUD,” retail-price comparisons, and any example numbers are provided for illustration only. They rely on assumptions and estimates that may not reflect your actual costs, sale prices, marketplace fees, shipping costs, taxes, returns, or results. Outputs from these tools are hypothetical and are not a projection, forecast, or guarantee of your earnings.
3. No Income or Earnings Guarantee
References on the Site or in our marketing to amounts earned by resellers (individually or collectively), success stories, screenshots, testimonials, and similar content reflect the reported experiences of specific individuals. They are not typical results and are not a promise that you will achieve similar results. Reselling is a business activity that involves risk, effort, skill, and time. Many people who resell earn little or nothing. We make no representation that you will earn any particular amount, or any amount at all.
4. Live Metal Prices
Gold, silver, and other market prices displayed on the Site are provided by third-party sources for general information only. They may be delayed, incomplete, or inaccurate. They do not represent the price of our products, the melt or material value of our products, or a price at which we or anyone else will buy or sell anything.
5. Not an Appraisal; Not Professional Advice
Nothing on the Site is an appraisal, and nothing on the Site constitutes financial, investment, tax, legal, or other professional advice. Our products are sold as jewelry, accessories, and related goods for personal use or resale — not as investments. Consult qualified professionals before making business or financial decisions.
6. No Buyback Obligation
Unless expressly stated in a separate written agreement signed by us, we have no obligation to repurchase, buy back, exchange for value, or facilitate the resale of any item you buy from us.
7. Third-Party Marketplaces
If you resell items on third-party platforms (for example, eBay, Facebook Marketplace, Depop, or in-person marketplaces), your activity is governed by those platforms’ own terms and policies. We do not control and are not responsible for marketplace fees, listing removals, account restrictions or suspensions, payment holds, buyer disputes, chargebacks, or any other action taken by a third-party platform or buyer.
8. Your Responsibilities as a Reseller
You are solely responsible for your own reselling activity, including:
- complying with all applicable laws and regulations, including consumer-protection and advertising laws such as the FTC’s Guides for the Jewelry Industry;
- accurately describing every item you resell, including its materials (for example, moissanite, lab-created or simulated stones, sterling silver, gold plating, or vermeil), and never representing simulated or lab-created stones as natural diamonds;
- honoring your own commitments to your buyers, including your own return, refund, and shipping terms;
- obtaining any required business licenses or permits and paying all applicable taxes on your sales.
9. Assumption of Risk
You acknowledge and agree that any purchase made for resale is made at your own risk, and that you are not relying on any estimated resale value, calculator output, earnings statement, testimonial, or other figure on the Site in deciding to purchase.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOST PROFITS, LOST REVENUE, LOSS OF BUSINESS OR OPPORTUNITY, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO ANY ESTIMATED RESALE VALUE, EARNINGS STATEMENT, CALCULATOR OR TOOL, EDUCATIONAL CONTENT, OR YOUR RESALE OF ANY PRODUCT. IN ALL CASES, OUR TOTAL LIABILITY RELATING TO ANY PRODUCT IS LIMITED TO THE AMOUNT YOU PAID US FOR THAT PRODUCT. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless JewelryResell and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your resale activity, including your listings, your representations to your buyers, and any violation by you of applicable law or of a third-party platform’s policies.
12. Mentorship and Educational Content
Guides, mentorship, Discord content, and other educational materials are provided for general informational purposes only. Applying them does not guarantee any result. You are responsible for how you use them and for ensuring that your own business practices comply with applicable law and with the rules of any platform you sell on.
13. Changes to This Policy
We may update this Policy at any time by posting a revised version on this page. The revised version takes effect when posted. Your continued use of the Site after a revision is posted means you accept the revised Policy.
14. Governing Law & Contact
This Policy is governed by the laws of the State of [MASSACHUSETTS], without regard to its conflict-of-law rules.
